{"id":139313,"date":"2022-05-06T12:56:53","date_gmt":"2022-05-06T11:56:53","guid":{"rendered":"https:\/\/www.vuelio.com\/uk\/?p=139313"},"modified":"2022-05-06T12:56:53","modified_gmt":"2022-05-06T11:56:53","slug":"ahead-of-the-queens-speech-financial-services-and-possible-legislation","status":"publish","type":"post","link":"https:\/\/www.vuelio.com\/uk\/blog\/ahead-of-the-queens-speech-financial-services-and-possible-legislation\/","title":{"rendered":"Ahead of the Queen\u2019s Speech: Financial services and possible legislation"},"content":{"rendered":"<p>A Financial Services Bill \u2013 now the Financial Services Act 2021 \u2013 was introduced in the 2019\u201321 session and received Royal Assent on 29 April 2021. It <a href=\"https:\/\/commonslibrary.parliament.uk\/research-briefings\/cbp-8705\/\">contained<\/a> a range of measures, including some related to Brexit following the end of the transition period and some aimed at making other improvements to the regulatory framework. At the time, Economic Secretary to the Treasury, John Glen <a href=\"https:\/\/hansard.parliament.uk\/commons\/2020-11-09\/debates\/4352E2B6-413C-4339-B751-73E99871A413\/FinancialServicesBill\">mentioned<\/a> the Bill was \u2018an important first step in taking control of our financial services legislation\u2019 but that a more \u2018fundamental review\u2019 of our financial services regulatory framework is needed.<\/p>\n<p>Back in February 2022, the <em>Financial Times<\/em> <a href=\"https:\/\/www.ft.com\/content\/9ce6a3ff-7dd6-4bff-8f8c-38cb1ea952c9\">reported<\/a> that a Financial Services Bill is expected in the upcoming Queen\u2019s Speech, which would \u2018set out a regulatory framework for the City\u2019. During an European Scrutiny Committee oral evidence session, Minister for Brexit Opportunities and Government Efficiency, Jacob Rees-Mogg also <a href=\"https:\/\/committees.parliament.uk\/oralevidence\/10126\/pdf\/#page=17\">confirmed<\/a> there would be a Financial Services Bill, to replace some retained EU law provisions.<\/p>\n<p>The Government\u2019s Financial Services Bill is likely to include a new Future Regulatory Framework. The Treasury launched in October 2020 a <a href=\"https:\/\/www.gov.uk\/government\/consultations\/future-regulatory-framework-frf-review-consultation\">consultation<\/a> on the Future Regulatory Framework, to determine how financial services regulation needs to adapt to be \u2018fit for the future\u2019. This was followed by a further consultation (which closed in February 2022) on its <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/1032075\/FRF_Review_Consultation_2021_-_Final_.pdf\">proposals<\/a>, including giving regulators a greater focus on growth and competitiveness by introducing them as new secondary objectives for the regulators. In an <a href=\"https:\/\/www.thetimes.co.uk\/article\/lets-not-provoke-another-financial-crash-5gbc0cbf7\">article<\/a> in <em>The Times, <\/em>member of the Treasury Committee and chair of the Fair Business Banking APPG Kevin Hollinrake, noted that \u2018asking regulators to focus on industry competitiveness risks sowing the seeds of another financial crisis.\u2019<\/p>\n<p>There are a number of financial services regulatory reforms that have been <a href=\"https:\/\/lordslibrary.parliament.uk\/queens-speech-2022-economic-affairs-and-business\/#heading-14\">highlighted<\/a> as areas for possible legislation either individually, or within a wider Financial Services Bill:<\/p>\n<ul>\n<li><strong>Insurance capital requirements<\/strong>. In February 2022, the Government <a href=\"https:\/\/www.gov.uk\/government\/consultations\/access-to-cash-consultation\">announced<\/a> reforms to the \u2018solvency II\u2019 rules that govern capital requirements for insurance companies. A <a href=\"https:\/\/www.gov.uk\/government\/consultations\/solvency-ii-review-consultation\">consultation<\/a> opened in April 2022.<\/li>\n<li><strong>Access to cash<\/strong>. In the 2020 Budget, the Government announced it would legislate \u2018to protect access to cash and ensure that the UK\u2019s cash infrastructure is sustainable in the long-term\u2019. The Treasury published a <a href=\"https:\/\/www.gov.uk\/government\/consultations\/access-to-cash-consultation\">consultation<\/a> document on access to cash on 1 July 2021, setting out its proposals. It is most <a href=\"https:\/\/commonslibrary.parliament.uk\/research-briefings\/cbp-9521\/\">likely<\/a> that any such legislation would be part of a wider Financial Services Bill.<\/li>\n<li><strong>Insolvency arrangements for insurers<\/strong>. The Government <a href=\"https:\/\/www.gov.uk\/government\/consultations\/amendments-to-the-insolvency-arrangements-for-insurers-consultation\">consulted<\/a> on reforms to insolvency arrangements for insurers. The response said the Government would continue to consult with relevant bodies and would legislate for reforms \u2018when parliamentary time allows\u2019.<\/li>\n<li><strong>Regulatory regime for wholesale markets.<\/strong> In 2021, the Government <a href=\"https:\/\/www.gov.uk\/government\/consultations\/uk-wholesale-markets-review-a-consultation\">consulted<\/a> on reforms to the regime. In its <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/1057897\/Wholesale_Markets_Review_Consultation_Response.pdf\">response<\/a>, the Government proposed reforms that it said would create a \u2018simpler and less prescriptive\u2019 regime now that the UK has left the EU, while maintaining or improving regulatory outcomes.<\/li>\n<li><strong>Credit unions. <\/strong>In the March 2020 Budget, the Government said that it would bring forward legislation allowing credit unions to offer a wider range of products and services.<\/li>\n<li><strong>Regulation of stablecoins and cryptoassets. <\/strong>In April 2022, following a consultation in 2021, the Government <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/1066166\/O-S_Stablecoins_consultation_response.pdf\">stated<\/a> that it intended to legislate to bring certain \u2018stablecoins\u2019 within the scope of regulation. A separate consultation on financial promotions for cryptoassets such as bitcoin <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/1047232\/Cryptoasset_Financial_Promotions_Response.pdf#page=8\">concluded<\/a> that regulations to reduce consumer risks would be introduced through secondary legislation.<\/li>\n<li><strong>Open finance and smart data. <\/strong>The FCA issued a \u2018call for input\u2019 on the wider possibilities of open finance in December 2019 and <a href=\"https:\/\/www.fca.org.uk\/publication\/feedback\/fs21-7.pdf\">published<\/a> a feedback statement in March 2021. The Government has also <a href=\"https:\/\/www.fca.org.uk\/publication\/feedback\/fs21-7.pdf\">consulted<\/a> in the area of \u2018smart data\u2019, publishing a response in September 2020.
